ACCEPTANCE OF TERMS

You agree that What Realtors Need is not responsible for any content you may be exposed to, content that you find offensive, inaccurate, misleading, or objectionable.  Furthermore, links or pathways to other web sites is at your own risk.  You agree that we will not be liable in any way whatsoever for any loss or damage of any kind you incur as a result of the use of this or any other web site.

WARRANTIES EXCLUDED
We make no representations or warranties of any kind, express or implied, in connection with the content found on this or any other web site.  This web site is provided “as is” and we make no warranty that the web site will be free from bugs, faults, defects, or errors, or that access to said web site will be uninterrupted.  We make no representations or warranties with respect to this or any other web site, the advertising of web site, it’s features, or any other services or performance of said web site.

Furthermore, you agree that use of this or any other web site and procurement of any goods and\or services is at your own risk.  What Realtors Need makes no warranty of any kind, express or implied.

PROBLEMS WITH WEB SITE
You acknowledges that the web site What Realtors Need may be subject to temporary shutdowns from causes beyond the operating party’s reasonable control.

THIRD PARTY CONTENT, SITES, AND SERVICES
You may access third party content which is independent of what realtors need.  Your interactions with these individuals and\or businesses, including the payment and delivery of goods or services, are solely between you and such organizations and/or individuals.  You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.  You agree that what realtors need shall not be responsible or liable for any loss or damage incurred as a result of any such dealings.

You agree that if there is a dispute between you and any third party, you understand and hereby agree to release what realtors need, its officers, employees, executors, administrators, successors, directors, shareholders, and attorneys, from any and all rights of action, claims and any demands whatsoever, known and unknown and which may hereafter develop.

It is further understood and agreed that all rights given by California Code of Civil Procedure section 1542 are waived by you.  California Code of Civil Procedure section 1542 provides:

"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTION OF THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."

INTEGRATION
These terms of use are the entire understanding between us.  We reserve the right, at our sole discretion, to change these terms at any time.  Such changes shall become effective immediately upon the posting thereof. You must review this agreement on a regular basis to keep yourself apprised of any changes.  If any provision of these terms of use shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect.

INDEMNITY
You agree to indemnify and hold What Realtors Need, its officers, employees, executors, administrators, successors, directors, shareholders, and attorneys, harmless from any and all claims, liabilities, and damages arising from, or in any way related to, your use of this web site, or its links or pathways, from any content, features goods, services or any other use.

CONTROLLING LAW
These terms shall be construed in accordance with the laws of the State of California.

VENUE
You agree that in the event any dispute arises between us, the dispute shall be resolved in a Superior Court in the State of California, County of San Diego.  Jurisdiction\Venue shall lie in the central division of the San Diego Superior Court.
